Conditions of Use
M Malan T/A Attitude Design is a sole proprietor retail business which procures, designs, manufactures and sells fashion accessories, art and décor goods, antiques and collectables as well as up-cycled products. All images are owned by Attitude Design. Attitude Design does not grant any express of implied rights to use the Products and Services. You agree not to copy, reproduce, republish, upload, post, frame, transmit, distribute, manufacture or create derivative works based on this Site. This include services, products, selection and arrangement.
We make use of various door to door courier companies within South Africa. We strive to get you order to you as quickly as possible. Please allow for between 5-7 days for delivery from date of dispatch depending on your location as our business is situated in an outlaying area.
All parcels must be signed for when delivered. Please ensure that you supply us with the correct delivery address and arrange with someone to sign for the parcel should you be unable to do so yourself. Parcels are delivered during working hours only. Delivery will be confirmed by email which will include a tracking number. Costs for courier services and SAPO are listed on the FAQ page.
Self-collection is free of charge if you reside in the Hangklip-Kleinmond area, during office hours on weekdays, 9:00 to 17:00, and Saturdays 9:00 to 14:00. At checkout, please select ‘Self-collect’ at the Shipping options and note your requirements in the comments section. Please confirm with us by WhatsApp or email.
We will process orders as speedily as possible. On receipt of payment, orders will be processed within 3 days (excluding weekends and public holidays). Products are packed with great care to ensure a safe journey to its destination. However, we do not take responsibility if a parcel is mishandled by the courier.
Returns and Refunds Policy
Provision of goods and services is subject to the description of the item/s on the website.
We undertake to disclose all details of an item/s in the description. The customer undertakes to inform Attitude Design within 48 hours on receipt of the goods. The customer must return a damaged item within 21 days of the invoice date. We will replace the item/s, depending on availability of stock, offer an exchange, or refund the customer on request within 21 days on the following conditions:
• the incorrect product/s was sent.
• the product/s was damaged by the courier.
• the product/s was short packed by Attitude Design.
Products will not be refunded if the customer ordered the incorrect product or quantities. Please note, the returned, damaged item must be unused and returned in the original packaging. We will cover the return and replacement shipping costs by applying the selected shipping method made by the customer on the original order checkout. In order to facilitate a fair and speedy process, we request that the customer supply us with at least 3 images of the damaged item/s. Please send the images to us via WhatsApp or email. Once the procedure has been finalized, a credit note, if applicable, will be emailed to the customer.
Policy on Custom Made Items
The customer will receive an email confirming and detailing all aspects of the custom order, as discussed mutually by the customer and a representative of Attitude Design. We will proceed with the custom order once full payment for the order reflects in our bank account. Should the customer want to cancel the custom order, it must be done by email or telephone, within 12 hours. Custom made items cannot be returned and refunded unless it is defective or damaged upon receipt.
We will take all reasonable steps to protect the personal information of users on our website. The privacy and protection of your personal information is important to us and we do not make any personal information available to third parties without your consent. However, consistent of transmission over the internet, we cannot fully guarantee its confidentiality and non-disclosure, upon which you transmit at your own risk.
In order to protect your personal information, all payments methods are secured by making use of the PayFast e-commerce portal. This includes card transactions and electronic funds transfers (EFT).
The transaction currency is South African Rand (ZAR). Currently we do not sell to regions outside the South African borders.
Attitude Design takes responsibility for all aspects relating to the transaction, including the sale of goods and services sold on this website, customer service and support, delivery of goods and dispute resolution of goods.
Updating of the Terms and Conditions
We reserve the right to amend the T&C’s at any time and without prior notification. Such changes will come into effect upon such changes have been posted to this Website. It is the responsibility of the user to periodically check these Terms and Conditions on the Website for changes or updates.
Consent by the user
I understand and accept that all designs and trademarks are registered to Attitude Design unless stated otherwise. I hereby accept the Terms and Conditions instated by Attitude Design. Should I be found to be in violation of these Terms and Conditions and agreement, I understand that I will be held liable for all legal costs incurred by Attitude Design for any civil action or any legal action deemed necessary against me.
